These Terms of Use (“Terms”) govern your access to and use of ATV Ref (the “site”) at https://atvref.eversources.app. By accessing or using the site, you agree to be bound by these Terms. If you do not agree, please do not use the site.
Not legal advice
ATV Ref is a structured reference compiled from publicly published state code sections and DNR / DMV rule pages. It is provided for general informational purposes only and is not legal advice. Reading the site does not create an attorney-client relationship.
State OHV statutes, fee schedules, and trail-pass rules change, and local enforcement can vary. Before riding in an unfamiliar state — and especially before relying on the atlas for a decision that has legal or safety consequences (e.g., letting a minor operate a machine on public land, crossing a state line on a non-titled vehicle, or converting a machine to street-legal) — you are responsible for verifying the relevant rules against the linked state DNR or statute source, and consulting a licensed attorney in your state where the answer matters.
Accuracy
We make a good-faith effort to source every atlas cell from the state’s code or DNR rule and to mark unverified entries unverifiedrather than guess. Even so, the atlas is provided on an “as is” and “as available” basis without warranty of any kind, express or implied. We disclaim all warranties to the fullest extent permitted by law, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. Acceptable use
You agree not to:
- Use automated means to scrape the atlas at a volume that materially burdens our infrastructure, or to republish the atlas pages verbatim as a competing reference;
- Bypass, disable, or interfere with security or rate-limit features of the site;
- Use the site to violate any applicable law or to facilitate any illegal activity;
- Misrepresent your relationship to ATV Ref (e.g., claim to be an editor, partner, or authorized representative when you are not).
The atlas content is free to read and free to share for personal, educational, and non-commercial reference. You may cite or quote short excerpts with attribution and a link back to the source page on this site.
Intellectual property
The site design, layout, written explanatory text, atlas schema, and compilation of state data into the matrix presented here are © ATV Ref. Statutory text and rule excerpts cited within the atlas remain the work of their respective state legislatures or agencies and are not owned by us. Linking to atlas pages is welcome and does not require permission.
Third-party links
The site links to state DNR sites, statute portals, and other public references as canonical sources. We do not control and are not responsible for the content, availability, or accuracy of those third-party sites. Inclusion of a link is not an endorsement.
Limitation of liability
To the fullest extent permitted by law, ATV Ref and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages — or any loss of profits, revenue, data, or use — arising out of or in connection with your access to or use of the site, including reliance on any atlas value, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless ATV Ref and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the site.
Privacy
Your use of the site is also governed by the Privacy Policy, which is incorporated into these Terms by reference.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the site will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. This clause does not deprive you of any mandatory consumer-protection rights you may have under the law of your country of residence.
Changes to these Terms
We may revise these Terms from time to time as the site evolves. Material changes will be reflected in the “Last updated” date at the top of this page. Your continued use of the site after a change constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
